The Implementation of New Low Carbon Fuels Act Delayed

The implementation of B.C.’s new Low Carbon Fuels Act will be delayed by one year to January 1, 2024 in order to provide more time for consultations with First Nations as well as stakeholders in the aviation and marine sectors. The government’s intention is to complete consultations and regulatory development in time for the new Regulations to be approved by summer 2023, providing all stakeholders with clarity regarding the changes that would come into force on January 1, 2024.

The Province remains fully committed to fulfilling the CleanBC Roadmap to 2030 commitments regarding low carbon fuels, and in order to do so the Ministry is preparing amendments to the Regulations under the current Greenhouse Gas Reduction (Renewable and Low Carbon Fuel Requirements) Act for consideration this Fall, to take effect January 1, 2023. These amendments will implement a new schedule of carbon intensity reductions to achieve a 30% reduction in the existing fuel pools by 2030. The Ministry will also recommend increasing the $200 penalty for non-compliance with the carbon intensity requirements to better align with the current estimated cost of compliance.
